The Numeracy Screener (“Numeracy Screener”, “us”, “we”, “our”) Application (“App”) allows Users to assess and track Student progress using a suite of tests of numerical and mathematical skills provided through the App.
Numeracy Screener is strongly committed to respecting the privacy of all Users of the Numeracy Screener-owned Website at www.numeracyscreener.app (our “Website”) and/or the App, as detailed in this Privacy Policy (“Policy”).
This Policy describes how we collect, use, disclose, retain and delete personal information (“PI”) in our custody or control.
Additionally, it sets out the responsibilities of those who use the App (“App Users”). App Users are responsible for complying with all their legal requirements regarding any PI they may collect, use and disclose in their use of the App.
This Policy applies to information we collect through the following Services we provide (“Services”):

In email, text, or other electronic messages between you and the Website or App, and
In person at our points of services, or by telephone when you contact us.
By participating in, accessing or using our Services and submitting PI through them, you consent to the collection, use, and disclosure of PI in accordance with this Policy and as permitted or required by law.
App User(s) means teachers, researchers, school boards who upload information about Students into the App.
Collect means to gather, acquire or obtain information by any means from any source. Disclose means to make information available to, or to release it to, another individual or organization.
Personal Information (“PI”) means any recorded information about an identifiable individual, in any form.
Student(s) means those children whose information is entered into the App by App Users.
Use means to handle or deal with the information or to apply the information for any purpose, including for the purpose of de-identifying the information.
User(s) means both App Users and Website Users.
Website User(s) means those people accessing and using the Website.
Collection of Personal Information by us about Users
We may collect PI from Users, which may includes:
First and last name,
Telephone number,
Mailing address,
Email address,
Device and Connection Information (e.g, IP address, browser type),
Website usage details (e.g., traffic data, logs, resources Website Users access on the Website), and
Records and copies of your correspondence with us.
Collection of Personal Information by App Users about Students
Limiting Collection
We limit collection of PI to only what is necessary to carry out the Services provided through the Website or the App.
Use of Student Information
With appropriate research ethics approval, we may use de-identified Student information for research purposes. We do not use PI of Students for research. Other than the above, we do not use information about Students collected by App Users for any purpose of our own.
It is the responsibility of App Users to ensure that any use of PI about Students is done in compliance with all applicable legal and regulatory requirements, and that they only use PI that they are permitted to. We are not responsible for ensuring that App Users comply with statutory requirements regarding any use of PI about Students.
Use of User Information
We only use PI about Users where necessary for the App to provide its services, for the functioning of the Website where the individual has provided consent, or where it is required by law.
We use your PI mainly for:
Providing you with use of our Website and App, and their contents to you,
Providing you with products or services that you request from us,
Responding to your questions and information requests,
Sending you notifications,
Ensuring compatibility with your operating system and its peripherals,
Delivering a personalized user experience, which may include stored preferences collected through cookies, if you choose to enable them,
Ensuring the Website and App remain functioning and secure,
Describing additional uses at the time you provide the information,
Complying with any applicable laws and assisting law enforcement agencies as required, and
Pursuing any other purpose with your consent.
Data Minimization
We use the minimum amount of PI needed and do not use more PI than is necessary in the circumstances.
Staff and contractors may not read, look at, receive or otherwise use PI unless they have a legitimate “need to know” as part of their duties.
Disclosure of User Information
We only disclose PI about Users that we collect or that you provide:
To fulfill the purpose for which you provided the information,
For any other purpose disclosed when you provide the information,
With your consent,
To comply with legal obligations, including court orders, laws, or regulatory requests,
To enforce our Terms of Use (www.numeracyscreener.com/terms) and other agreements, and
To protect the rights, property, or safety of Numeracy Screener, our employees, our contractors, our customers, or others, including sharing information with organizations for fraud prevention and credit risk reduction.
We may share aggregated or non-identifiable information about Users without restriction.
Disclosure of PI about Students
We only use PI about Users where necessary for the App to provide its services, for the functioning of the Website where the individual has provided consent, or where it is required by law.
We use your PI mainly for:
Providing you with use of our Website and App, and their contents to you,
Providing you with products or services that you request from us,
Responding to your questions and information requests,
Sending you notifications,

We may request and obtain an individual’s consent for the collection, use or disclosure of their PI. Consent is considered valid only if it is reasonable to expect that the individual would understand the nature, purpose and consequences of the collection, use or disclosure to which they are consenting. We will notify the individual at the time of seeking their consent of their choice to consent, withhold consent or withdraw consent after it is given. Withdrawal of consent may be subject to legal or contractual restrictions and reasonable notice.
We make every reasonable effort to ensure that the PI we collect, use and disclose is accurate and complete. Individuals may contact us at any time to update their PI.
We will retain PI for only as long as is required to fulfil the purposes of collection. Please note that different types of PI may be subject to different retention periods, depending on the specific purpose for which the data was collected.
When the retention period ends, PI that is no longer required will be destroyed, erased, or de-identified safely and securely. Where necessary, de-identification will be sufficiently performed so that the information can no longer be used, directly or indirectly, to identify you.
We will use care in the disposal or destruction of PI, to prevent unauthorized parties from gaining access to the information.
It is the responsibility of App Users to ensure that PI about Students is retained and disposed of in accordance with any applicable legal or regulatory requirements.
We take reasonable steps to protect the PI we hold against loss, theft or unauthorized access, commensurate with the sensitivity of the data. We put in place reasonable administrative, physical and technical security measures to protect PI. Safeguards include:
Physical safeguards (such as locked filing cabinets and rooms),
Organizational/administrative safeguards (such as permitting access to personal information by staff on a “need-to-know” basis only, privacy training, and employee confidentiality agreements), and
Technical safeguards (such as the use of passwords, encryption and audits).
We ensure that access to your PI by us is restricted at all times to those Numeracy Screener employees or authorized subcontractors who are legally required to have access to that information in order to perform the services offered through our Website or App.
Your role is also important in safeguarding your information. If you have been provided with or have chosen a password to access certain areas of our Website or App, it is your responsibility to keep it confidential. Please do not share your password with others. We are not liable for the information escape of Users arising from their failure to safeguard their PI.
An individual may examine or view a copy of the PI we hold about them by making a request to us in writing. Individuals may also request correction of PI we hold about them. We will make every effort to respond to access or correction requests within 30 days.
In certain situations, we may not be able to provide access to all the PI we hold about an individual. The reasons for denying access will be provided to the individual in our response to the request.
For PI necessary for your User account, we cannot delete such PI except by also deleting your user account.
We may not be able to accommodate a request to change PI if we believe the change would violate any law or legal requirement or cause the information to be incorrect. However, to make sure that the PI we maintain about you is accurate and up to date, please inform us immediately of any change in your PI. We will make best efforts to provide a response to your request within thirty (30) days.
It is the responsibility of App Users to ensure they allow Students from whom they collect PI to exercise these rights.
We may update this Policy from time to time to reflect, for example, changes to our practices, or for other operational, legal or regulatory reasons. Where we make material changes to this Privacy Policy, we will notify you by appropriate means (such as by posting a prominent notice on our Website or by email) before the changes take effect. We encourage you to review this Policy periodically for the latest information about our privacy practices.
Your continued use of the Website or App after we make changes constitutes your acceptance of those changes.
We are responsible for PI in our custody or control. We are accountable for compliance with this Policy and any applicable Canadian privacy laws. We are committed to addressing any questions or concerns you may have about how we collect, use and disclose your PI.
Under applicable Canadian privacy laws, you have the right to lodge a complaint with the privacy regulator in the applicable jurisdiction. We encourage you to contact us first to resolve any concerns, but you are free to approach the relevant regulator at any time.
